Syllabus of Unit 4 :-

  1. Study of Salient Features of Drugs and Magic Remedies Act and its rules : Objectives, Definitions, Prohibition of certain advertisements, Classes of Exempted advertisements, Offences and Penalties.

  2. Prevention of Cruelty to animals Act - 1960 : Objectives, Definitions, Institutional Animal Ethics Committee, CPCSEA guidelines for Breeding and Stocking of Animals, Performance of Experiments, Transfer and acquisition of animals for experiment, Records, Power to suspend or revoke registration, Offences and Penalties.

  3. National Pharmaceutical Pricing Authority : Drugs Price Control Order (DPCO)- 2013. Objectives, Definitions, Sale prices of bulk drugs, Retail price of formulations, Retail price and ceiling price of scheduled formulations, National List of Essential Medicines (NLEM).

1. Drugs and Magic Remedies Act

The Drugs and Magic Remedies (Objectionable Advertisements) Act, 1954 is an Act of the Parliament of India which controls advertising of medication in India. It prohibits advertisements of medicine and remedies that claim to possess magical properties, and makes doing so a cognizable offence.

The act defines "magic remedy" as any talisman, mantra, amulet or the other object which is claimed to own miraculous powers to cure, diagnose, prevent or mitigate a disease in humans or animal. It also includes such devices that are claimed to possess power to influence structure or function of an organ in humans or animals.

The law prohibits advertising of medicine and remedies for :-
  1. Inducing miscarriage or preventing conception in women 
  2. Improving or maintaining the capacity for pleasure correction of menstrual disorders
  3. Curing, diagnosing or preventing any disease or condition mentioned in an included schedule.

2. Prevention of Cruelty to animals Act - 1960

The Prevention of Cruelty to Animals Act, 1960, authored by acclaimed dancer and animal lover, Rukmini Devi Arundale, is an Act of the Parliament of India enacted in 1960 to forestall the infliction of unnecessary pain or suffering on animals and to amend the laws referring to the prevention of cruelty to animals As per the provisions of the law the govt. of India formed the Animal Welfare Board of India.

The act however makes a provision under heading [Chapter VI, Heading 28]: "Saving as respects manner of killing prescribed by religion: Nothing contained during this Act shall render it an offence to kill any animal in a very manner required by the faith of any community." Naresh Kadyan, Chief National Commissioner together with Mrs. Sukanya Berwal, Commissioner on Education, Scouts & Guides for Animals & Birds, introduced two legal books, associated with PCA Act, 1960 in Hindi together with mobile app: Scouts & Guides for Animals & Birds, Abhishek Kadyan with Mrs. Suman Kadyan also contributed from Canada.
